Magnuson Lowell Blog
Each week we post a blog about relevant legal issues. Glance through our various topics to learn more about a particular legal situation.
These articles are for limited informational purposes only and are not, nor are they intended to be, legal advice. You should not rely on this information for your case and should consult with an attorney for advice regarding your individual situation.
Throughout the years, stories have developed of assault against patients who have undergone a general anesthetic. More often than not, these assaults and batteries are reprehensible and should lead to jail. On other occasions, these actions lead to monetary damages mostly because they aren't injurious, but, rather, are amusing - although in bad taste. These assaults may be the impetus for a Personal Injury claim. And, a lawyer may be best suited to help you determine what your claim may be worth.
The thought of doctors having cell phones in the operating room during your surgery should scare you. An anesthesiologist in California has been sued for placing black stickers (in the shape of a mustache) on his unconscious patient's face and taking photographs. This obvious breach of professionalism is not only a violation of the patient's privacy, but it is also a tortious offense brought to a lawsuit. These victims may be entitled to money damages for the suffering and humiliation stemming from these attacks.
Even worse, several years ago, a dentist was sued after implanting tusks as a practical joke into the mouth of his assistant (and has the photos to prove it). Despite the pedestal that we often place the medical profession on, even doctors, occasionally, need reeducation regarding common sense. Leave it to say these outlandish cases are never a "boar." If you feel you've been the victim of a tortious assault and battery, call Magnuson Lowell, P.S. for a free initial Personal Injury consultation.
